Last October, Kanokporn Tangsuan, a doctor from New York, visited Disney World in Florida with her husband and mother. Doctor Tangsuan died after eating food that contained allergens she was deadly allergic to, despite the staff at the particular restaurant repeatedly assured them that it did not.
Tangsuan's husband is now suing on behalf of her estate for negligence. Disney however is asking the court to force Tangsuan's husband into arbitration. According to them, when he signed up for a free month-long Disney+ streaming trial in 2019, he agreed to a TOS that required him to resolve any disputes with Disney through arbitration. Disney argues that this agreement applies not just with the particular Disney+ streaming service, but with any and all Disney subsidiaries; and that it was not just in effect for the period of the month-long trial, but a permanent agreement that applies
into the future forever.
