I don't what the law is in Texas, obviously. In English law, though, one of the elements of attempted murder the prosecution must prove is intent to kill, which is why (for example) deliberately wounding someone with a knife doesn't automatically get charged as attempted murder, even though it almost certainly would be charged as murder if their injuries were fatal. After all, if someone is stabbed in most parts of the body it's very much a matter of luck whether or not a major artery is damaged, and if it is, then the outcome depends on the ambulance response time and the surgeon's skill.
