More than 26K rape-related pregnancies estimated after Texas outlawed abortions, new study says

Texas saw an estimated 26,313 rape-related pregnancies during the 16 months after the state outlawed all abortions, with no exceptions for survivors of rape or incest, according to a study published Wednesday in the Journal of the American Medical Association.

That’s the highest estimate among the 14 states with total abortion bans, with Texas having the largest population, according to the study. The figure helps put the magnitude of the state’s laws into perspective, especially for those who can’t access abortion pills or travel out of state to receive abortion care, said one of the authors, Dr. Kari White of the Texas-based Resound Research for Reproductive Health.

Florida asks state Supreme Court to keep abortion rights amendment off the November ballot

Lawyers trying to keep an abortion-rights measure off the Florida ballot told the state Supreme Court on Wednesday that the proposed amendment is deceptive, and that voters won’t realize just how far it will expand access to the procedure.

Proponents of the proposed amendment say the language of the ballot summary and the proposed amendment are concise and that Moody is playing politics instead of letting voters decide whether to protect access to abortions.

“The language of the summary and the amendment are clear and unambiguous,” Courtney Brewer, a lawyer for Floridians Protecting Freedom told reporters after the hearing. “Florida voters will be able to understand that and I am confident based on the court’s questioning today that they understand that as well.”

The group gathered nearly 1 million voter signatures, well more than the 891,523 needed to make the ballot. The court has made clear that it’s role is not to rule on the content of the proposed amendment, but rather, whether it is properly focused on a single subject, and whether voters will understand what they’re voting on.

The state banned almost all abortions after the U.S. Supreme Court in 2022 overturned Roe v. Wade. Abortions currently are only legal “in cases of medical emergency.”

Democratic state Sen. Tracy McCreery said Missouri's current law goes too far and called on her colleagues to “show an ounce of compassion" for victims of rape and incest.

“What we’re saying is, ‘We don’t care,’” McCreery said of the state's current abortion ban. “We’re going to force you to give birth, even if that pregnancy resulted from forcible rape by a family member, a date, an ex-husband or a stranger.”

McCreery tried adding amendments to allow exceptions for abortion in cases of rape and incest to a Republican-sponsored bill that would continue blocking taxpayer funding from going to Planned Parenthood.

Both of McCreery's amendments were voted down along party lines in the Republican-led Senate, and debate on the underlying bill was cut off before a final vote Wednesday.

Alabama Rules That Frozen Embryos Are 'Children'

In a theology-heavy ruling, the Alabama Supreme Court will allow a couple to sue for the "wrongful death" of their frozen embryos obtained through IVF.

The Alabama Supreme Court ruled Friday that frozen embryos are children, which pro-choice rights groups have warned could have dangerous implications for fertility treatments such as in vitro fertilization.

The Alabama Supreme Court on Friday reversed Mobile County Circuit Court Judge Jill Parrish Phillips’ decision to dismiss a lawsuit in which a couple sued an Alabama fertility clinic and hospital for the “wrongful death” of their frozen embryos in a ruling that was riddled with theology. The couple’s frozen embryos were destroyed after a hospital patient who accessed the freezer that held the embryos dropped them on the floor. The ruling means that the couple can sue for wrongful death.

“[T]he Wrongful Death of a Minor Act is sweeping and unqualified. It applies to all children, born and unborn, without limitation,” the ruling said. “It is not the role of this Court to craft a new limitation based on our own view of what is or is not wise public policy. That is especially true where, as here, the People of this State have adopted a Constitutional amendment directly aimed at stopping courts from excluding ‘unborn life’ from legal protection.”

The ruling pointed to the Alabama Constitution Section 36.06, which argues that each person was made in God’s image, meaning each life has an incalculable value that “cannot be wrongfully destroyed without incurring the wrath of a holy God.”

South Dakota GOP realizes people want abortion, panics

And so, as the 2024 election approaches, with reproductive rights activists pushing to get abortion-rights amendments on ballots in almost a dozen states, Republican politicians have been throwing spaghetti at the wall to find a way to stop them. The most recent example comes from South Dakota, where state law currently prohibits all abortions, except those needed to save a pregnant person’s life. There, a group called Dakotans for Health is collecting signatures to get a limited right to abortion enshrined in the state constitution.

As they’ve done in other states, Republicans are trying to stop the amendment from going before voters: On Friday, Republican Gov. Krisiti Noem signed a bill to allow people to revoke their signatures from ballot initiative petitions.

The campaign needs to collect 35,017 signatures by May 7 to qualify for the ballot. Dakotans for Health co-founder Rick Weiland says they’re already there, with 50,000 signatures in the bag. Based on history, the prognosis is good if the amendment does get to the ballot: South Dakota voters rejected abortion-ban measures in 2006 and 2008, long before the Supreme Court’s Dobbs decision sent support for abortion rights soaring.

To South Dakota’s anti-abortion Republicans, this an emergency. Literally: The new signature revocation law includes an emergency clause allowing it to take effect immediately. Under the new law, voters who want to revoke their signature from a ballot initiative petition have to send a notarized letter using registered mail to the secretary of state. The bill is transparently targeting the abortion-rights initiative. Its main sponsor, Republican Rep. Jon Hansen—who sits on the board of directors for South Dakota Right to Life—claimed to South Dakota Searchlight that people had been “misled, or frankly, fraudulently induced,” into signing Dakotans for Health’s abortion rights petition. “People have approached me and they said, ‘Hey, I signed that abortion petition because I thought it was pro-life. That’s what they led me to believe,’” Hansen alleged.

Apparently, people in South Dakota can't read what they're signing. And this is against an amendment that's barely pro-choice:

To be clear, the proposed abortion-rights amendment in South Dakota is weaksauce. It would prohibit the state from interfering in “a woman’s abortion decision and its effectuation” only in the first trimester. In the second trimester, it would allow state restrictions on abortion as long as they’re “reasonably related to the physical health of the pregnant woman.” And third-trimester abortions could be banned, unless they are necessary to save the life or preserve the health of the parent. As a result, the regional affiliates of Planned Parenthood and the ACLU have declined to back Dakotans for Health’s campaign.

It's not just the assault on abortion rights, which they can't seem to hold back from, despite the resounding unpopularity of the anti-choice stance. It's that the MAGA base is getting ever more vitriolic with its misogyny. Part of that is due to the more secular dirtbags of the Joe Rogan/Elon Musk variety, who have become such a loud part of the Republican coalition under Trump. But this escalation of boldly misogynist rhetoric is also coming from the evangelicals. Republicans can't win without keeping those people happy, since the Christian right is where the GOP's organizing power still mainly resides.

The Republican gubernatorial nominee, Mark Robinson, is a good example. He loudly proclaims himself an evangelical Christian and occasionally is invited to preach at conservative churches. He also prefers a shock jock vibe when attacking women being sexual or demanding equality. He declared that women are to be "led by men" and, "I absolutely want to go back to the America where women couldn’t vote." Last week, resurfaced comments showed he's consumed by hatred for Beyoncé, who he called a "skank" who teaches "our young women to be hyper-sexual wh*res."
