I’m getting older and need glasses to read fine print, but of course I don’t wear them and keep reading Trump as Turnip on line. I like it. Adds a little bit of fun to otherwise horrid news.

I tried, I really did. MSNBC carried the audio transcript from today's hearing appealing Chutkin's ruling. I felt like I had to be a constitutional scholar to understand a lot of the Special Prosecutor's presentation.

Then the Trump lawyer took the mic and I realized that, no, I don't. :rimshot:

The mainstay of Trump's argument seems to be the idea that a former President is completely and totally immune from any laws while in office. So, since he was still President when he started his insurrection, he's therefore immune from prosecution. They claimed.

It was hard listening to D. John Sauer (on the side of evil) because he either had the most epic throat cancer in history or he's been talking too much. It became hard to listen to him.

I've never been a lawyer or even played one anywhere, but I was struck by the naivete of the defense's arguments. I could hear Trump's voice in their words, verbatim.

The judges asked whether this prosecution would open a "floodgate" of other legal actions against former Presidents. I guess if your arguments are shallow, you can assert any stupid thing you want. You'll still get swatted down, but it will at least delay the verdict another few days until you can return to power and commute everything for everybody. Meanwhile, Smith's team reminded the court that there was no "floodgate" after Watergate and none after Iran-Contra. (When did we ever think that jurisprudence was a matter of public opinion?)

Judges appear skeptical of Trump’s Jan. 6 immunity claim (Wash Post. Paywall).

On two separate occasions, Trump nodded as his lawyer spoke — first when Sauer said that the acts in question in the case occurred while he was president. The former president nodded again when Sauer talked of a “frightening future” if the case proceeded and future presidents could, he said, readily be charged with crimes after they left office.

I almost want this to be found true.

Then Biden just says, "I can do whatever I want!" Then just throws out all these MAGA idiots.

But you know, evil does not stop evil, blah blah blah.

JOHN SAUER: If he were impeached and convicted first.

In other words, if his political party will back him, and controls either the House or the Senate, (will refuse to bring articles of impeachment in the House, or will refuse to convict by a 67-vote majority in the Senate), there is absolutely no limit on a President’s criminal behavior.
