Acting Attorney General Todd Blanche’s principal focus in recent weeks has been lining up support on Capitol Hill ahead of his upcoming Senate confirmation hearings, with a specific focus on winning over GOP skeptics. But Donald Trump’s controversial former defense attorney has more troubles than lining up 51 votes.

As this week got underway, Democracy Defenders Fund, Lawyers Defending American Democracy and a group of 101 former federal and state judges filed a complaint against Blanche with the New York State Bar, which included a formal request for an ethics investigation.
The 73-page complaint specifically focused on three areas of alleged misconduct:
  • Blanche’s role in orchestrating the creation of a $1.776 billion compensation fund, widely panned as a “slush fund,” and an IRS audit shield for the president and his family.
  • Blanche’s role in “abusing the investigative and prosecutorial powers” of the Justice Department to target the president’s perceived political enemies, including former FBI Director James Comey.
  • Blanche supervising the DOJ’s “flawed response to the Epstein Files Transparency Act, including the disclosure of thousands of records containing sensitive victim information.”

As has been widely reported, several people have been arrested on suspicion of vandalising the reflecting pool by stripping the American Flag Blue paint from the bottom, including the former Olympic athlete David Hearn, who is to appear in the DC superior court on July 9.

Can someone please explain the US charging structure? Here in the UK, the police, after arresting and interviewing the suspect on suspicion (criminal damage, in this case) send a tape of the interview, the arresting and interviewing officers' statements and any other evidence in the case to the prosecuting agency (Crown Prosecution Service in England and Wales or the Procurator Fiscal in Scotland, who decide whether or not this evidence will support a charge, or if they need more information.

The CPS would ask for a court date after deciding they've got a case, not before, but in this case they seem to have gone ahead and filed a case with the DC superior court anyway.

What's going on here? On the face of it, this case isn't going to go anywhere, since unless the prosecution think they can make the jury sure that they saw the defendants actually taking steps to strip the paint off the bottom of the pool, as opposed to simply touching it, or removing fragments that had already detached and were floating in the water, it's a no-hoper.

Judges over here don't take kindly to having their and the court's time wasted with obviously defective prosecutions, and I'd be astonished if the evidence is such that there's even the slimmest chance of a conviction in this case.

In theory that is pretty close to how it works in the US when we have a functioning government. We do have the wrinkle that there can be State or Federal prosecution, although both are pretty similar. In the case of vandalism on the National Mall, it is all Federal property with the Park Service as the primary police force. Because there is only Federal jurisdiction, the process is open to undue influence by political actors. When Trump calls for prosecutions, the DoJ is now listening and is aware of the number of Prosecutors dismissed for failing to take action on his tweets.

The series of high profile dismissals over the last year have been because a felony charge in most cases must be presented to a Grand Jury first. This is usually a low bar because they only have to show that there is enough evidence to bring a case to trial, they don't have to prove a case. But increasingly the Federal prosecutors have either brought thin cases or mislead Grand Juries as to both the legal standards to bring a charge or the strength of the evidence.

So they are going for misdemeanor charges that they can file directly. Many still will not survive the first hearing due to lack of evidence or misapplied legal theory. We are starting to see courts get very short with Federal prosecutors, and the presumption of good faith is going away. I expect to see actual disciplinary moves against Federal prosecutors (a few are close to actual referrals for disciplinary action) and would not be surprised if some people lose their licenses over the most blatant moves. Malicious prosecution motions almost always fail, but we are seeing courts take them more seriously now with a few successes that would have been unheard of two years ago.

U.S. judges are pretty much in line with that now.

These "prosecutions" are basically performative harassments to please Trump. In several cases, the grand juries simply refused to follow through, which is very rare. Learning from those failures, DoJ began to lie to grand juries instead, but then their misconduct was discovered later during the trial process, incurring significant ire from the judges.

It's important to remember that winning these cases isn't the top priority for the DoJ. The top priority is not pissing off Trump.

I'd just like to remind everyone of the fact that the USA is currently engaged in an illegal war of aggression with Iran (that was started to divert attention from the Epstein files) and America's leader spends most of the day obsessing over a reflecting pool that he ruined.


Imagine this was 2016 and someone told you this was going to happen.

Trump has always been a very obvious piece of shit.

Honestly, my biggest wonder would be how he managed a third term, assuming dates are provided. Not realizing/knowing there was someone in between.

I recently saw a French documentation showing a new music sub culture in Redneck Land, which calls itself Country Rap. The delusions of these people are highly disturbing.

Just put them in the middle east and they would make great muslimic terrorists with their content.
