I was listening to Brian Tyler Cohen and Glen Kirchner (sp) discussing what will happen next in this case. In a nutshell, it will be appealed to the 11th Circuit, and then ultimately to the Supreme Court. That's not great news, since at least one of the Justices is all but certain to take Trump's side. Clarence Thomas was the one who gave Judge Cannon the idea to dismiss the case. We can only hope that the majority of them see the idea that special counsels are unconstitutional as the big, steaming pile of bullshit that it is, and then gives the case to a competent judge.

The 11th is not the 5th. They have smacked down Cannon multiple times already. And it takes four Justices to accept a case, with Thomas being an outlier here. While this does delay the case, at this point if Trump does not win the election it will eventually go to trial.
