It started on Saturday when Trump and his team reached out to talk to Raffensperger, who, according to an adviser, felt he would be unethically pressured by the president. Raffensperger had been here before: In November he accused Trump ally and South Carolina Sen. Lindsey Graham of improperly exhorting him to meddle in the election to help Trump win Georgia. Graham later denied it.

So why not record the call with the president, Raffensperger’s advisers thought, if nothing else for fact-checking purposes. “This is a man who has a history of reinventing history as it occurs,” one of them told Playbook. “So if he’s going to try to dispute anything on the call, it’s nice to have something like this, hard evidence, to dispute whatever he’s claiming about the secretary. Lindsey Graham asked us to throw out legally cast ballots. So yeah, after that call, we decided maybe we should do this.”

With only 16 days left before DT is forced to leave, there's not enough time to impeach him again. But if the House really wanted to, they could still impeach NOW and let him leave as the only President to be Double Impeached in US history - a fitting record for a man who never understood or appreciated the Constitution when it came to limiting his own power.

I don't expect it to happen, but a question I have is whether he can be charged when out of office for this bold and undisguised attempt to pervert election law. As a civilian, he can be charged (even if it's only in Georgia state court) but will he?

Don't think insanity would fly. It is pretty clear that he knows what he's doing, as he repeatedly backpedals to another option every time he is challenged. That requires problem solving (evil as it is), conniving, remembering what he's heard and repeating it, etc. His ideas and commentaries do border on whacked, for wont of a better term, but don't seem to meet criteria for psychotic. I view them as wilful, vindictive, self-serving absolute corruption, not mental illness other than serious sociopathic personality disorder stuff.

The Fulton County District Attorney seems ready.

The Secretary of State's office is in the state capitol, which is in Atlanta, which is in Fulton County. DA Willis was elected in August 2020. Fulton County is so blue that both candidates were democrats. Ms Willis is also a black woman. I don't think she will have any problem prosecuting if there is enough evidence to make a good case.

I don't know about US courts but insanity is a very difficult defence to run in an English court, unless someone is, in fact, so seriously mentally ill that they don't know what they're doing, or completely delusional (so they thought the man they attacked was, in fact, a monster who had come to kill them).

There's diminished responsibility, which can provide a partial defence to some crimes (in particular, bringing murder down to manslaughter) but that's rather different.

Georgia has an option for "Guilty but with intellectual disability" that might help Trump.
A defendant who is found guilty but mentally ill at the time of the felony or guilty but has intellectual disability shall be committed to an appropriate penal facility and shall be evaluated then treated, if indicated, within the limits of state funds appropriated therefor
I'm sure they have put at least $2.00 into those state funds.

We've got an incapacity defence, when the defendant is actually incapable of forming the necessary intent -- so someone suffering from significant learning difficulties or cognitive impairment.

I think I'd actually be ok with Trump using an insanity plea with narcissism disorder if only because it would ruin his ability to continue controlling the Republicans. I'd rather see him face jail time, though.
