In a flash, the tragic death of one of the most substantial political and cultural figures of our time became just another gateway drama. The added note of cruelty: RBG’s replacement will be tasked with undoing much of what she believed in.

This may be politics as usual for those who play in the swamp, but for many of us it is horrible and sick-making to watch; a total lack of respect afforded not just to Ginsburg and her family and loved ones, but also—and why should one have to say this?—because it is utterly appalling to behave like this after somebody has just died.

If you have ever lost a loved one, if you have ever experienced grief, you may have felt the horror of watching callous, inappropriate behavior that has nothing to do with politics. It was not an unfamiliar feeling with this administration—this is wrong, this disgusts me—but it was sharper than ever before.
Short thread by Nate Silver on how this probably won't go down too well with the voters, which makes sense to me -- if you're not disgusted by the way the Republicans have behaved, you're likely to be voting for them anyway, while many people, regardless of their politics, are going to feel this is not way to behave when a major public figure dies, and less enthusiastic about voting for the cynical ghouls who think it's acceptable to behave this way.

These aren't my pipe dreams, they're things being mentioned by serving Senators who are just as irate about this as we are.
This one requires a Constitutional Amendment. The others are possible, but getting enough states to pass this would be nearly impossible.

Another problem with court packing is that we’re not playing one-move chess here: there will be a tit-for-tat response. When the GOP regains power, it could pass a law demoting a group of justices to the lower courts—a move which would very likely be constitutional. And then it could “re-pack” the Court with a new set of right-wing justices. If this is the game we end up playing, then we’ve only deepened our political dysfunction. (Indeed, that was Biden’s argument against the idea.)

There is another, better, way to rein in partisan judges: by stripping the Supreme Court, and also the lower federal courts, of jurisdiction where Congress does not want partisan judges second-guessing particular decisions—especially where, as is so often true, the Constitution does not speak directly to an issue and courts are making political choices rather than legal judgments. That strategy, while perhaps a bit more difficult to reduce to a sound bite or a campaign slogan, gets directly at the problem of partisan judicial activism. It is also a more focused and less overtly politicized approach compared with court packing.

Perhaps the most powerful argument for jurisdiction stripping is that the Constitution clearly permits it. Article III, section 1 of the Constitution gives Congress complete discretion on whether to create the lower federal courts, a power that Congress has used from the founding to limit lower courts’ jurisdiction. And Article III, section 2, clause 2 explicitly empowers Congress to make “exceptions” to the Supreme Court’s appellate jurisdiction—that is, to pick and choose for approximately 99 percent of the Supreme Court’s total docket what cases the Court has the power to hear.

Had that been the case in earlier years, though, what would have become of Roe vs Wade, or Obergefell vs Hodges or Miranda vs Arizona or Brown vs Board of Education?

As far as I'm concerned the entire US system of government is a mess, but I'm really not sure this is the way to fix it. I mean, he writes

Well, sure it is, but how's persuading the current GOP to leaven its politics with decency going?

This seems a spot-on analysis -- her religious beliefs and affiliation should not automatically disqualify her from consideration but certainly deserve close scrutiny

As the Senate prepares for yet another brutal Supreme Court nomination fight, one particularly sensitive issue is creating apprehension among Democrats: what to do with 87-year-old Sen. Dianne Feinstein, the ranking member of the Judiciary Committee.

Feinstein, the oldest member of the Senate, is widely respected by senators in both parties, but she has noticeably slowed in recent years. Interviews with more than a dozen Democratic senators and aides show widespread concern over whether the California Democrat is capable of leading the aggressive effort Democrats need against whoever President Donald Trump picks to replace the late Justice Ruth Bader Ginsburg.
