The ERG -- Jacob Rees-Mogg and his fellow Brexiteers -- have been unable to mount any sort of a challenge against Theresa May's leadership of the Conservative Party, which they'd been threatening to do if they didn't get their way over a hard Brexit.


It's rather annoying that the government seem only just to have realised that the ERG are a bunch of fantasists, incompetents and grifters, and have wasted two bloody years trying to placate them rather than trying to conduct serious negotiations with the EU27.

The ERG was, in effect, a WhatsApp group formed by people who had every intention of organising something big together. And like almost every other such WhatsApp group, a large number turned out to be really sorry they couldn't make it.

Spain demands Gibraltar veto in Brexit deal

Spain has said it will not agree to the draft Brexit withdrawal deal without clarity over how talks on the future status of Gibraltar should be handled.
Foreign minister Josep Borrell insisted that talks about the territory were "separate negotiations".
The country will not agree to the draft deal until that is clarified, he said following a meeting with EU ministers.
Article 184 of the draft Brexit deal says the EU and the UK will seek to "negotiate rapidly the agreements governing their future relationship" between the official day of withdrawal on 29 March 2019 and the end of a transition period in December 2020.
But Spain insists on its future right to discuss the status of the peninsula bilaterally with the UK, and is seeking clarity that this draft deal will allow it to do so.

Essentially, the House of Lords have refused to block an application to the European Court of Justice asking them to rule on the circumstances in which a country's Article 50 notification may be revoked.

The ECJ will now hear the matter on November 27, so there's every possibility that, by the time Parliament votes on the Withdrawal Agreement, the argument that "it's this deal or no deal" will have been demolished, since the third option of withdrawing the A50 notification will be firmly back on the table.

So the UK's highest court decided, that EU's highest court has a say in that kind of matter. This for sure makes the hard core Brexiteers double red with anger.

The UK is still part of the EU, so it would be very strange if the EU Court of Justice would be denied to rule over an EU matter.

The question wasn't whether the ECJ have jurisdiction -- of course they do -- but whether British courts can be asked to refer hypothetical questions to the ECJ (hypothetical since the government has indicated it has no intention of withdrawing the A50 notification).
