The Satanic Temple Demands FDA Grant Unrestricted Access to Abortion Drugs

Lawyers for The Satanic Temple (TST) sent a letter to the Food and Drug Administration (FDA) to request that TST be able to access abortifacients without being subjected to the agency's regulations.

TST places certain voluntary abortions in a religious context with its religious abortion ritual. During the procedure, adherents affirm their religious beliefs of bodily autonomy and scientifically-reasoned personal choice. In their letter to the FDA, TST's legal council states, "TST has every desire to ensure the health and safety of its membership… the issue is with governmental control over whether TST's membership can obtain access to these drugs."

I don't. I think it's stupid. For one, it capitulates to the right's framing of the issue by asserting that abortion is a religious ritual for one thing - a special kind of idiot must've thought that one up to begin with. But said idiot is also apparently not familiar with the power of governments, protected by the courts, to curtail specific organized religious rituals in cases where the activity is deemed dangerous or harmful (like animal sacrifices or illicit drug use for instance).

I think these guys should stick to trolling with statues and only addressing less-important issues like that where multiple outcomes are equally "okay".

So you're argument is to not try and use the religious right's framing against them, but to continue fighting within and against that framing, until someone figures out, in some way, at sometime, ways to overcome it.

They had a great economic boom going... COVID might be wrecking it by now though. They do like to sometimes shoot themselves in the foot by being as conservative as humanly possible...

As I understand it, were Texas to have introduced this law as a straightforward piece of criminal legislation, forbidding abortions save under these particularly oppressive restrictions, then there's a clear legal mechanism to suspend its introduction until it's been subjected to judicial review, and someone asks a court to issue an injunction suspending the law's introduction until after the issues have been resolved.

So presumably the first time someone tries to bring a civil action under this law, it will then be open to the defendants to challenge the law's constitutionality and, at that point, the federal courts become involved and can start issuing interim injunctions.

But in the meantime, everyone's worried about being sued.
