Elon Musk’s $134bn claim against OpenAI rests on ‘numbers out of the air’, judge says

The judge in Elon Musk’s more than $130bn lawsuit against OpenAI and Microsoft has suggested the billionaire’s claim for damages is based on “numbers out of the air”, but ruled he can still make his case to a jury. Lawyers for OpenAI, at a hearing on Friday, tried to convince Judge Yvonne Gonzalez Rogers to dismiss evidence from an expert witness to support Musk’s claim for $134bn in damages.

The world’s richest man argues OpenAI and chief executive Sam Altman defrauded him by abandoning its non-profit roots after he had made charitable donations to the AI lab a decade ago. A trial is set for April.

“A jury is going to understand that [Musk’s expert] is pulling these numbers out of the air,” Rogers told a pre-trial hearing in California’s northern district on Friday.
Assuming California law on evidence is anything like English law, that's the right decision -- it's generally for the jury rather than the judge to decide on the credibility of witnesses and their evidence.

Musk's lawsuit against a coalition of companies that he asserted were illegally boycotting Twitter/X by refusing to buy ads on it, has been dismissed after a judge ruled that what he claimed they were doing wasn't actually an anti-trust violation.

France is doing prosecution right.

The world’s richest man and Linda Yaccarino — the former CEO of X — have been summoned for “voluntary interviews", while other employees of the platform are scheduled to be heard as witnesses throughout this week, the Paris prosecutor’s office said.

It remains unclear whether Musk and Yaccarino will travel to Paris. A spokesperson for X did not respond to questions from The Associated Press and Yaccarino’s current company, eMed, did not answer a request sent to the press email.
Musk was summoned after a search took place in February at the French premises of X as part of an investigation opened in January 2025 by the cybercrime unit of the Paris prosecutor’s office. Musk and Yaccarino have been invited in their capacities as managers of X at the time of the events investigated. Yaccarino was CEO from May 2023 until July 2025.

“These voluntary interviews with the executives are intended to allow them to present their position regarding the facts and, where appropriate, the compliance measures they plan to implement,” prosecutors said. “At this stage, the conduct of this investigation is part of a constructive approach, with the ultimate objective of ensuring that platform X complies with French law, insofar as it operates within the national territory.”
Asked whether Musk would risk sanctions if he skipped the hearing, the Paris prosecutor's office declined to comment.
The implied threat of sanctions might be enough.
