The idea there is to avoid something like a dictator locking up their opposition. There has to be a happy middle. Commit tax fraud, illegal stock trades? You should not be trusted with any government position involving apportioning funds, which would lock them out completely.

The article acts as though Biden will personally be pursuing a case against Trump. That really isn't the case, at least for now. It is NY and they've been developing that over quite some time now. Whomever Biden appoints AG may or may not pursue other crimes and that could be seen as Biden pursuing Trump.
