From what I've read, Trump and his Justice Department are using indictments as a form of lawfare to punish people who offend them. The cases themselves stand no chance of success (at some point a court will dismiss the charges against Comey, just as were the cases against Comey and Leticia James last year and, more recently the attempt to prosecute David Hearn for vandalising the Reflecting Pool).

The point is, though, to punish people by causing them the stress, inconvenience and expense of being accused, regardless of the outcome.

To my mind, no one thought to indict Milo for anything because even the most enthusiastic members of Trump's army of online trolls would recoil from the idea that right-wing polemicists might be prosecuted for harassing and shitposting on social media.
