Certainly it could be, but I would certainly not be able to regard Ms Powell as a credible witness, in that her unsupported word would now be valueless in court, I think.Then again, it could be the one time ashe's telling the truth and could explain why McCarthy has been threatening companies if they give info to the commission.
If she can produce persuasive evidence in corroboration of her account, then that's different, but otherwise why believe a word she has to say any more than you'd believe the My Pillow Guy?
